Terms of Use Concerning the MAHLE Customer Portal (hereinafter: CustomerCare Portal)

Please read the following Terms of Use Concerning the MAHLE CustomerCare Portal carefully. Use of the MAHLE CustomerCare Portal by an employee constitutes your implied acceptance of these Terms of Use. The provider of the MAHLE CustomerCare Portal is MAHLE Aftermarket GmbH (hereinafter referred to as “MAHLE”).

Section 1 - Scope

These Terms of Use apply to the MAHLE CustomerCare Portal. In order to continue using the CustomerCare Portal, the customer is required to accept the terms specified below.

By using the CustomerCare Portal, the customer agrees to be bound by our Terms of Use. Use by the customer shall also be understood to include use of the CustomerCare Portal by an employee of the customer.

Section 2 - Availability of the CustomerCare

The MAHLE CustomerCare Portal shall be made available 24 hours a day. However, there may be times when availability is interrupted owing to necessary maintenance work. Interruptions in availability may also occur due to force majeure, technical malfunctions, or other causes for which we are not responsible.

MAHLE would like to draw your attention to the following points:

  • From a technical perspective, it is impossible to make the CustomerCare Portal available entirely without errors of any kind, and MAHLE therefore accepts no responsibility for such errors.
  • Errors may lead to a temporary shutdown of the CustomerCare Portal.
  • The availability of the CustomerCare Portal is dependent on circumstances and services beyond MAHLE’s control such as transmission capacities or services offered by service providers/processors used by MAHLE to operate the CustomerCare Portal. MAHLE cannot be held responsible for any disruptions that fall into this category.

Section 3 - Access to the MAHLE CustomerCare Portal

Access to the MAHLE CustomerCare Portal is granted to every MAHLE customer and every employee of the customer authorized by the customer to use the CustomerCare Portal.

A (company) e-mail address and a password assigned by the customer to the employee are required in order to log in to the CustomerCare Portal. The customer support advisor responsible for the customer concerned assigns the initial password and communicates it to the customer once the customer’s registration has been approved by Sales and Shipping. The customer can then create a new password independently via the “Forgotten your password?” function and the identity service provider (IDP). Thereafter, this new password is known only to the customer and stored in encrypted form by MAHLE.

The customer is responsible for their employees, in particular for the process of selecting employees.

If an authorized employee of the customer ceases to be entitled to use the CustomerCare Portal after a certain period of time, due to the employee leaving the company or assuming other duties, for example, the customer is required to notify MAHLE without undue delay as to which employee is to be denied access to the CustomerCare Portal, so that the employee’s e-mail address and password can be blocked by MAHLE in a timely manner. MAHLE shall not be held responsible if this information is not communicated or its notification is delayed and the customer suffers damage as a result.

Section 4 - Liability

MAHLE’s liability is limited to intent and gross negligence.

Section 6 - Changes to the Terms of Use

MAHLE reserves the right to make changes to the CustomerCare Portal, the privacy statement, and these Terms of Use unilaterally and at any time.

Should any provision of these Terms of Use be invalid, that provision shall be deemed severable and shall not affect the validity of the remaining provisions.

Section 7 - Place of jurisdiction and choice of law

German law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Stuttgart/Germany.
